Terms of Service

These Terms of Service ("Terms") govern your access to and use of coachnadira.com (the "Site") and all products and services offered by coachnadira.com ("Coach Nadira," "we," "us," or "our"), including digital downloads (the Stress Reset Card Deck, Gut-Friendly Recipe Cards, Reset Ritual Habit Tracker, Morning & Evening Ritual Workbook, and 7-Day Anti-Inflammatory Reset), the Magnesium Oil spray, the Resilience Rebuild 1:1 coaching program, and the free Body & Mind Wellness Collective Facebook community (together, the "Services").

By accessing the Site, purchasing a product, booking a call, or joining the community, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who Can Use the Services

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products, enroll in coaching, or join the Facebook community. By using the Services you represent that you meet this requirement.

2. Educational Purpose Only — Not Medical Advice

Coach Nadira provides wellness coaching, educational content, and lifestyle tools. Nothing on the Site, in any digital product, in the Facebook community, or in a coaching session is medical, psychological, nutritional, or other professional advice, and it is not a substitute for care from a licensed physician or other qualified provider. See our full Health & Wellness Disclaimer, which is incorporated into these Terms by reference. If there is a conflict between that Disclaimer and these Terms on health-related matters, the Disclaimer controls.

3. Digital Products

• All digital products (card decks, workbooks, trackers, and guides) are sold and delivered as downloadable files through Systeme.io, our checkout and delivery provider.
• Upon purchase, we grant you a limited, non-exclusive, non-transferable, personal license to download and use the product for your own personal, non-commercial use.
• You may not resell, redistribute, share, publicly post, or claim authorship of any digital product, in whole or in part, without our prior written consent.
• Because digital products are delivered instantly and irrevocably, please review our Refund & Return Policy before purchasing.

4. Physical Products (Magnesium Oil)

• The Magnesium Oil spray is a physical product shipped to the address you provide at checkout through Systeme.io.
• Shipping times, carriers, and costs are as stated at checkout and may vary by destination; we are not responsible for delays caused by the shipping carrier or customs.
• Product descriptions are provided in good faith, but we do not warrant that descriptions or other content are completely accurate, current, or error-free.
• The Magnesium Oil spray is a dietary/wellness supplement and is subject to the statements in our Health & Wellness Disclaimer, including that it has not been evaluated by the U.S. Food and Drug Administration and is not intended to diagnose, treat, cure, or prevent any disease.

5. Coaching Services (The Resilience Rebuild and Discovery Calls)

• Discovery/free calls are booked through TidyCal and are provided for the purpose of discussing whether coaching is a good fit; they do not create a coaching relationship on their own.
• Paid coaching engagements, including the Resilience Rebuild, begin only once a separate coaching agreement is signed and any applicable payment is made. That agreement will set out the program length, session cadence, fees, payment schedule, and cancellation/rescheduling policy in more detail, and will control over these Terms for anything it specifically addresses.
• Coaching is a collaborative process. We do not guarantee specific outcomes, results, or timelines, and your results will depend on your own effort, circumstances, and follow-through.
• Please see Section 8 (Payment, Cancellations, and Refunds) and our Refund & Return Policy for payment-related terms.

6. The Free Facebook Community

• The Body & Mind Wellness Collective is a free community hosted on Facebook and governed by Facebook’s own terms in addition to these Terms.
• Membership is offered at our discretion. We may remove content or members who violate community guidelines, are disrespectful or harassing, or share promotional/spam content.
• Content shared by members is their own opinion and experience, not advice from Coach Nadira, and is not confidential — please do not share anything in the group you would not want other members to see.

7. Testimonials and Results

Any testimonials, reviews, or results shared on the Site, in marketing materials, or by other clients reflect individual experiences and are not a guarantee that you will achieve similar results. Wellness outcomes vary from person to person.

8. Payment, Cancellations, and Refunds

Digital and physical product purchases are processed securely through Systeme.io. Coaching payments are handled as described in your individual coaching agreement. 9. Intellectual Property

All content on the Site and in our digital products — including text, graphics, logos, images, card deck designs, and workbook layouts — is owned by or licensed to coachnadira.com and is protected by copyright and other intellectual property laws. Except for the limited personal-use license described in Section 3, nothing in these Terms transfers any ownership or license to you.

10. User Conduct

When using the Site, purchasing products, or participating in the community, you agree not to:

• Violate any applicable law or regulation;
• Infringe our intellectual property or that of any third party;
• Upload harmful code, attempt to disrupt the Site, or attempt unauthorized access to our systems;
• Harass, threaten, or abuse other users, members, or Coach Nadira;
• Use the Services for any unlawful or unauthorized purpose.

11. Disclaimers

The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any product, program, or advice will meet your expectations or produce any particular result.

12. Limitation of Liability

To the fullest extent permitted by law, coachnadira.com, Nadira Smith, and our contractors and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Site or Services. Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us in the six (6) months before the claim arose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless coachnadira.com and its owner, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

14. Governing Law and Disputes

These Terms are governed by the laws of Barbados without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the courts located in Barbados, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continuing to use the Site or Services after changes are posted means you accept the updated Terms.
